Terms of Service

1. Who you're contracting with

Arqo is operated by Arqo, a sole establishment licensed in Dubai, UAE (Dubai Media City, DDA, licence no. 105721) ("Arqo", "we", "us"). By creating an account or using the service, you agree to these Terms.

2. The service

Arqo is a subscription software platform that provides AI-assisted tools for brand strategy, including research, positioning, messaging, and content. We may update, improve, or change features over time.

3. Accounts

You must be at least 18 and provide accurate information. You're responsible for activity under your account and for keeping your credentials secure.

4. Subscriptions, billing, and renewals

  • Paid plans (Core, Pro, Max) are billed in advance on a monthly or annual basis, in US dollars, through our payment processor.
  • Subscriptions renew automatically at the end of each period unless cancelled beforehand. You can cancel anytime from your account; cancellation takes effect at the end of the current paid period, and you keep access until then. We do not provide pro-rata refunds for the unused part of a period, except as required by law.
  • We may change pricing; we will give reasonable notice, and changes apply from your next renewal.
  • Plans include generous fair-use limits on AI processing, set well above what a typical user needs, so they won't affect normal use. In the rare case of unusually heavy usage, we may pause further AI generation until your next cycle or until you upgrade — and we'll always alert you before you get close.

5. 30-day money-back guarantee

If Arqo isn't right for you, you can request a full refund within 30 days of your first payment — just email hello@arqo.studio. This applies to your first purchase. After that, subscriptions renew automatically and aren't refundable for partial periods, though you can cancel anytime to stop future renewals. If you are a consumer, this guarantee is in addition to any rights you have under the law of your country.

6. Your content and outputs

Your content stays yours. You keep all rights in the brand, project, and strategy information you put into Arqo ("your content"). We don't claim ownership of it, and we treat it as confidential (see section 7).

You own what Arqo produces for you. As between you and us, you own the strategy, messaging, and content outputs the platform generates from your inputs, and you're free to use them for your business. You're responsible for reviewing outputs before you rely on or publish them.

The limited permission you give us. You grant us only the rights we need to run the service for you — to store, process, and transmit your content (including sending it to our AI provider) so that we can generate your outputs and operate, secure, and support the platform. We don't use your content for any other purpose.

Improving the service. We may use aggregated, de-identified information that does not identify you or reveal your content to operate and improve Arqo.

Feedback. If you choose to send us suggestions or feedback, we may use them to improve the service without any obligation to you.

7. Confidentiality

We treat your content as confidential and won't disclose it except as described in our Privacy Policy — for example, to the providers that run the service, or where the law requires. Our personnel do not access your content except where you ask us to (such as support), or where necessary for security or to comply with law, and any such access is limited to authorised personnel on a need-to-know basis, with administrative actions logged.

In turn, you agree to keep confidential any non-public information about the platform that we share with you, such as non-public features, methodology, or pricing.

8. Acceptable use

You agree not to, and not to permit anyone else to:

  • use Arqo to break any law or regulation, or to infringe anyone's intellectual-property, privacy, or other rights;
  • input or process content you do not have the right to use;
  • resell, sublicense, or otherwise make the service available to third parties outside your account, or use it to build, train, or benchmark a competing product;
  • copy, scrape, or systematically extract the platform, its outputs at scale, or its underlying methodology;
  • probe, scan, or test the security of the service, or bypass usage limits, rate limits, or other technical or access controls;
  • reverse-engineer, decompile, or attempt to derive the source code or models behind the service, except to the extent the law expressly permits;
  • upload malware or interfere with or disrupt the integrity or performance of the service; or
  • generate unlawful, harmful, or abusive content, including any content that exploits minors.

We may monitor use for compliance and may warn, suspend, or terminate accounts, remove content, or report activity to authorities where appropriate.

9. Our intellectual property

The platform, its software, design, and underlying methodology are ours and remain our property. These Terms don't grant you any rights in them beyond using the service.

10. Business customers and data protection

If you use Arqo to process personal data on behalf of your own clients (for example, as an agency), you act as the data controller and we act as your processor for that data. A Data Processing Addendum (DPA) is available on request and, where required by data-protection law, forms part of these Terms.

11. Disclaimers

The service is provided "as is" and "as available". Arqo produces AI-assisted outputs that require your judgment; we don't warrant that outputs are accurate, complete, current, or fit for a particular purpose, and we don't provide legal, financial, or other professional advice. To the extent permitted by law, we disclaim implied warranties.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or for lost profits, revenue, or data. Our total aggregate liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

13. Your indemnity

To the extent permitted by law, you will indemnify and hold us harmless from third-party claims, losses, and reasonable costs (including legal fees) arising from your content, your use of the service, or your breach of these Terms or of any law or third-party right.

14. Third-party services

The service relies on third-party providers, for example for hosting, payments, email, and AI processing. We are not responsible for the acts, omissions, availability, or outages of those providers, and your use of the service may also be subject to their terms.

15. Events outside our control

We are not liable for any failure or delay caused by events beyond our reasonable control, including third-party provider outages, network or infrastructure failures, acts of government, or other force-majeure events.

16. Suspension and termination

You may stop using the service and delete your account anytime. We may suspend or terminate access for breach of these Terms, to protect the service or other users, or to comply with law.

17. Governing law and disputes

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Before bringing any formal claim, you agree to contact us first and try in good faith to resolve the matter. Disputes that cannot be resolved that way will be subject to the courts of Dubai, UAE.

If you use Arqo as a consumer, nothing in this section removes the protection of any mandatory laws of the country where you live, and you may also be able to bring proceedings there.

18. General

  • Entire agreement. These Terms, together with the Privacy Policy and any plan-specific or enterprise terms, are the entire agreement between you and us about the service.
  • Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
  • No waiver. If we don't enforce a right, that is not a waiver of it.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation, merger, or sale of our business.
  • Notices. We may give notice to you by email or through the service.
  • No service-level commitment. Unless we expressly agree a separate written service-level or enterprise agreement, the service is provided without any guaranteed uptime or support response time.
